General Terms and Conditions of Sale

1. Purpose

The purpose of these General Terms and Conditions of Sale (GTCS) is to define the rights and obligations of the parties in the context of the sale of services and subscriptions offered by the company Target Tech (the Editor) via the target-tech.fr platform.

Any subscription to a subscription or purchase of a license implies unreserved acceptance of these GTCS by the user (the Client).

2. Proposed Services

Target Tech is a software solution in SaaS (Software as a Service) mode for shooting training by laser simulation via webcam.

Access to the service is conditioned by the creation of a user account on the site and the subscription to one of the available access formulas (Free, Premium, or Club).

3. Tariffs and Payment

The prices of our offers are indicated in Euros and are all taxes included (TTC). Invoicing is handled directly by the Editor Target Tech.

Subscriptions are billed in advance on the subscription anniversary date. Secure online payment is made through the PayPal platform. The Client can thus pay for their order using their PayPal account balance or directly by Credit Card (Visa, Mastercard, etc.) via the secure PayPal interface, without obligation to create an account.

The Editor reserves the right to modify their rates at any time. However, they guarantee the Client the application of the rate in effect on the day of order validation or renewal of the engagement period.

Activation codes: Activation codes crediting the user account for a fixed duration of 1 month or 12 months can also be purchased from partner resellers authorized by Target Tech.

Price control: The Editor ensures rigorous control over the prices charged by its authorized resellers. This measure aims to guarantee that license prices remain market-compliant, fair, and homogeneous for all users, regardless of the chosen point of sale.

Purchase from Third-Party Resellers: The Editor is not a party to the sales concluded between the Client and a third-party reseller. Any claims regarding invoicing, terms of sale, or refund requests for an activation code purchased from a reseller must be addressed directly to that reseller. The Editor disclaims all liability for transactions or financial disputes occurring outside the target-tech.fr platform.

4. Limitation of Liability and Equipment

Target Tech is exclusively a virtual simulation software.

  • The service does not in any case replace real shooting training, nor the learning of fundamental safety rules taught by a qualified instructor within an authorized organization.
  • Laser regulations: The user is solely responsible for the laser equipment (replicas, pointers) they use. The use of Class 1 and Class 2 lasers is authorized for individual training. The use of Class 3R lasers is strictly regulated and reserved for professional use framed by law. The Editor declines all responsibility in case of misuse or use of laser equipment not conforming to the regulations in force in the user's country.
  • The Editor cannot be held responsible for any accidents, injuries, personal injury or material damage occurring during real shooting practice or while using simulation equipment. The user acknowledges using this simulator under their sole and entire responsibility.

5. Right of Withdrawal and Refund

In accordance with Article L221-28 of the French Consumer Code, as it is a SaaS service of digital content provided on an intangible medium whose execution begins immediately after payment, the consumer expressly waives their right of withdrawal upon subscription.

Consequently, no refund or exercise of right of withdrawal is possible once access to Premium or Club services is validated and activated on the user account.

6. Duration and Termination

The Editor offers two subscription formulas with engagement:

  • Monthly Subscription: Subscribed for a duration of one (1) month, tacitly renewable each month on its anniversary date.
  • Annual Subscription: Subscribed for a duration of twelve (12) months, tacitly renewable each year on its anniversary date.

The user can terminate their subscription at any time and without fees via their "My Account" space. The termination will be effective at the end of the current billing period. No pro-rata refund will be granted for the remaining subscription period.

"Lifetime" Purchase Packages (Lifetime Access): Some license offers may be proposed as a "lifetime" purchase. This access is guaranteed solely for the active lifetime and commercial operation of the target-tech.fr online platform by the Editor (Target Tech). In the event of a definitive cessation of the Editor's activities or the permanent closure of the platform, access to services and licenses will terminate automatically, and no refund or compensation of any kind may be claimed by the Client.

7. Availability and Maintenance

The Editor strives to ensure service availability 24/7.

However, they cannot be held responsible for momentary or prolonged interruptions of the service related to maintenance operations, application updates, or technical failures of the Internet network beyond their direct control.

8. Personal Data

The Editor collects and processes the personal data of its subscribers and clients only for the needs of the service, in accordance with current laws and the General Data Protection Regulation (GDPR).

9. Force Majeure

The execution of the Editor's obligations under these terms will be suspended in case of occurrence of an act of God or force majeure (as defined by Article 1218 of the French Civil Code) which would prevent or delay its execution.

The Editor will notify the Client of the occurrence of such an act of God or force majeure as soon as possible. General power outages, telecommunications or cloud network failures are considered as cases of force majeure releasing the Editor from its liability.

10. Governing Law and Disputes

These GTCS are governed and interpreted in accordance with French law.

In case of a dispute arising from the interpretation, execution, or termination of the sales contract, and after an unsuccessful attempt at amicable resolution, the dispute will be submitted to the exclusive jurisdiction of the Commercial Court of Strasbourg, even in case of multiple defendants or third-party appeals.
